All vases must be returned to en train de bloom. Any rental items must be retrieved by en train de bloom in the same condition as when delivered. In the event that items are damaged, client will have one week to fulfill an invoice for the affected items(s). Client agrees to exercise all due care in caring for, and preserving the property of en train de bloom. Clients shall remain responsible for all loss or damage to rentals, up to and including actual replacement value for each missing or damaged item per cost. Items rented such as candles, hurricane vases, urns, and vases will be gathered by en train de bloom at the end of your event. Please let guests know to not take any rented items home.
At the signing of this contract, a $300 deposit is due. This is a non refundable payment. The deposit is not an added expense and goes toward the final cost. If the deposit has not been payed, en train de bloom may except another wedding on your date and no longer be available.
Client will pay the total cost on or before each payment's due date. If the total cost is not payed one month prior to the event date, en train de bloom may cancel this contract.
In the case that anything changes outside of this invoice and contract, it is the client's responsibility to reach out to en train de bloom via email and update en train de bloom on any changes that have been made to venue, times, location, drop off etc. Unless otherwise stated in the invoice, any changes will incur a fee of $50 in addition to the cost of the added items. Upon entering this Agreement, this order's value cannot be reduced. Any changes to the event date and/or location must be made in writing, and a new contract signed. When client requests a change of items after signing this contract, there is no refund for the removal of items. If set-up time changes (from what was originally discussed in the first contract) or amount of items change or are added, client agrees to pay any added labor fees that are needed to execute client's vision or other fees needed to work within the new timeline agreed upon.
Once a payment has been made to en train de bloom, it is non refundable. If the client cancels the contract before a payment is due, they are not liable for future payments. en train de bloom reserves the right to cancel this contract at any time if the obligations cannot be met.
Due to conditions outside of our control, flowers received from wholesalers and growers are not always suitable quality for a wedding or event. Any specific flower variety can also vary in appearance and color because of a difference in growing conditions. In instances where quality, appearance, and/or color is not deemed acceptable by the florist, or desired varieties are not available, en train de bloom reserves the right to make substitutions for other flowers within the proposed color scheme with similar aesthetic and value.
Due to artistic copyright laws en train de bloom will not recreate exact products/arrangements/bouquets shown as examples in photos, magazines or proposals. In this case, the integrity of the proposed color scheme will be maintained, and the flowers of equivalent value will be used. Please inform your designer if there are flowers you deem as unacceptable alternatives. Due to the nature of organic materials, en train de bloom cannot be held responsible for variation in color or size of flowers.
Once flowers are delivered by en train de bloom, en train de bloom is not liable for condition of flowers. It is the clients responsibility to follow instructions for flower care, i.e. keeping the bridal bouquet in a vase of water whenever possible.
Under no circumstances is it acceptable for clients or others to alter, change, or rearrange the style or design shape of ANY product en train de bloom was hired to provide/install for your wedding/event. If there are concerns about the structure and design stability, or a design is considered unsatisfactory, notice should be given to en train de bloom immediately and en train de bloom will proceed as they see best fit for the current situation. Failure to notify or consult with en train de bloom before any personas alter or change a design will result in a $600.00 fine. Client agrees to pay this $600.00 fine.
All documentation created and provided to client is owned and copy written by en train de bloom and cannot be used or given to any other vendor, 3rd party or florist unless given written consent.
en train de bloom can use photos received from the photographer or videographer of your event, as well as take and use their own photos or videos of the flowers from your event.
en train de bloom will be the only floral provider. Under no circumstances may the client bring in other flowers done by themselves or another florist. Failure to comply will result in a $600.00 fine. Client agrees to pay this $600.00 fine.
When contacted with a request, question or situation in need of attention, en train de bloom will respond in a timely manner, within 48 business hours. Business hours are: Monday-Friday: 8:00 am to 5:00 pm. When a request is more time sensitive or an emergency, en train de bloom will respond to clarify how time sensitive the request is and proceed accordingly.
Flowers are live product and should be treated with care. En train de bloom will not be responsible for any damage done to the flowers after delivery, including damage done from extreme weather conditions. En train de bloom is not liable for anything not amounting to an intentional wrong. Under any circumstances, total liability shall not exceed the total compensation received by en train de bloom under this Agreement. It is understood that en train de bloom is not liable for the services of other contracted vendors. It is understood that in no event shall en train de bloom be liable for consequential damages of any kind. En train de bloom is not responsible for Acts Of God, Natural Disasters, an Act Of Government such as A Declaration of National or Local Emergency, or Other Incidents not within the control of the consultant, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance.
The undersigned have read this contract, understand its terms, and agree to be bound thereby. Any additions, deletions, or revisions must be made in writing and approved by all responsible parties. The parties agree that this contract is the complete and exclusive statement of the mutual understanding of the parties.
